In a Case Management Statement filed this week, the Jahi McMath family claims that the “issue of brain death is now moot.” 

If the parties can agree at the August 1 CMC, then planned discovery on that issue would be canceled. The separate February 2019 trial date originally scheduled for brain death would instead be used for a trial of the wrongful death and NIED claims.
