Federal Appeals Court Will Hear Constitutional Challenge to California Brain Death Law

The U.S. Court of Appeals for the Ninth Circuit has asked the parties in Fonseca v. Smith to select an oral argument hearing date in December 2018 or early 2019. 

The lawsuit, which had been dismissed by the Northern District of California for lack of standing, challenges the constitutionality of the California Determination of Death Act.
