On December 31, 2018, 32-year-old son David Ruiz had a stroke that left him in a coma at St. Joseph’s Hospital in Tuscon, Arizona. As of January 9, 2019, the hospital allegedly withheld nutrition and hydration.
David’s mother, Patricia Adames, opposed this plan. It is unclear whether Adames is Ruiz’s surrogate. If she is, then it looks like the hospital was not permitted to withhold treatment unless that was authorized in his advance directive.
Arizona law requires that “a health care provider shall comply with health care decisions made by the patient’s surrogate unless those decisions are inconsistent with the patient’s health care directive as known to the provider or the provider has transferred responsibility to another provider.”
In any case, the hospital has now apparently caved-in to pressure that the family obtained from right-to-life advocates. The hospital has resumed David’s nutrition and hydration.
