In his new Executive Order, President Trump declares: “It is the policy of the United States to increase access to kidney transplants by modernizing the organ recovery and transplantation systems and updating outmoded and counterproductive regulations.”


While not specifically mentioned, one of the “outmoded and counterproductive regulations” that needs updated is the dead donor rule. This rule prohibits procuring both kidneys from an individual until after that individual is first declared dead.


Every day, more than 1000 patients and surrogates decline life-sustaining treatment for seriously ill patients. We already allow hastening of death. Why not allow organ procurement before the patient is dead.
