Yesterday, Cook Children’s Hospital succeeded in removing Texas Judge Alex Kim from the Tarrant County court case between the hospital and the family of Tinslee Lewis.

The Hospital argued that Judge Kim violated judicial standards by assigning himself the case. The Hospital also argued that Kim was influenced by groups trying to end that rule and therefore cannot be impartial. For example, the judge liked posts on Facebook in support of an anti-abortion group that helped contact him to sign the restraining order. 

This may all be true, and Judge Kim should have recused himself. But the Hospital’s recusal motion highlights its own hypocrisy. The hospital itself already adjudicated the conflict between itself and the family. As a party to the dispute, the hospital is no more independent, neutral, and unbiased than Judge Kim.
