I started a resource page on the Tinslee Lewis case. This is a dispute over potentially inappropriate treatment at Cook Children’s Hospital in Fort Worth, Texas. The case is now pending before the Texas Second Court of Appeals.
There have been four other court cases challenging the constitutionality of the dispute resolution provisions in the Texas Advance Directives Act. But none of those courts reached the merits of those claims, because the patient died during the litigation process.
In contrast, here, Tinslee Lewis is still alive at Cook Children’s. This may permit the Texas Second Court of Appeals to issue a precedent-setting judgment, perhaps as early as March. Depending on the ruling, this could impact not only Texas but also states like Virginia that have similar dispute resolution provisions.
