The Coroner of Tasmania has faulted Launceston General Hospital for administering treatment to Kylie Anne Breen contrary to instructions in her advance directive.
“This investigation . . . highlights . . . the importance of treating health professionals being alerted to the existence of an ACD, understanding its significance and then giving effect to the patient’s wishes expressed within it.”
As a growing trend of recent U.S. cases shows, penalties for non-compliance with advance directives are important. If we want more people to complete advance directives, we must fulfill the promise that they help assure they are effective in helping avoid unwanted treatments.
