In July 2020, the Texas Court of Appeals declared the dispute resolution provisions in the Texas Advance Directives Act unconstitutional. In this morning’s Order List, the U.S. Supreme Court denied certiorari in COOK CHILDREN’S MEDICAL CENTER v. T. L., No. 20-651. That means the Texas Court of Appeals decision stands. 

Yes, the Court of Appeals judgment was only a decision on the preliminary injunction and not on the merits. But no party expects a different result from the Tarrant County District Court. It appears the days are numbered for the TADA 10-day rule.
