Multi-disciplinary Exploration of the Ethical Challenges Raised When Incapacitated Patients Refuse Medical Treatment 

This program, jointly sponsored by the Metropolitan Ethics Network and the Social Work section at NYAM, will explore the issues raised by incapacitated patients who refuse recommended medical care. Refusal of care is an expression of autonomy that must be honored by clinicians under most circumstances. However, if a patient’s decision-making capacity is called into question, their decision, which may be detrimental to their health and well-being, may not stand. Challenges presented stem from complicated legal and ethical considerations, the difficulties of assessing whether or not a patient has capacity, and interactions between patients, their families and other loved ones, and clinicians. The interdisciplinary panel will address these challenges and offer a framework for health care professionals to respond to ethics consultations that may arise during the course of care.
