Nearly two weeks ago, 21-year-old Damaire Gordon Friday died at Erie County Medical Center. He did not have a healthcare agent and his parents disagreed about how to proceed. So, the matter went to court.

But why? There is no decision to be made. Hospitals do not administer organ-sustaining treatment to corpses except to enable organ procurement. This is well-settled in medical practice and in substantial appellate jurisprudence. Why did this hospital think they needed consent from the parents?
