Coincidentally, the same day that the Texas Court of Appeals ruled that the Texas Advance Directives Act is “likely unconstitutional,” the British High Court of Justice ruled that Great Ormond Street Hospital for Children similarly violated principles of fairness and procedural due process.

The hospital’s ethics committee had met and decided on a course of action for a 9-year-old girl without “prior consultation or participation” with the parents. The court ruled that this “cannot be good practice and should generally be unacceptable.”

“There should be guidance on patient/family participation and a clear protocol of how and when they are informed as to the arrangements being put in place for an Ethics Committee to meet along with being informed as to the outcome.”
